The seller informed me the item was out of stock but said they can’t cancel the order

Only the seller can cancel the order. If you paid by paypal, the seller goes to paypal and refunds, then goes to their transaction statements and requests the return of their fees.
If you used Amazon Payments..again the seller refunds through Amazon payments and then the same as above.
If you used direct checkout, the seller goes to their Booth settings, clicks on the Booth Payment account status and refunds the credit card payment.
As the buyer you cannot do anything…to cancel but you can contact support to help you with the seller

They certainly can cancel the order. The item should not have been active in their booth if they were out of stock.
Worse comes to worse, and you cannot get them to refund, go to paypal, Paypal will make them refund you.

That is ridiculous. If the item is not in stock then they have to cancel the order. Contact the seller again, if they refuse, contact PayPal, they will open a case if need be, & you will receive a refund through PayPal.
